DUI / DWI

Some things to remember:
- Within days of the traffic stop the ALR hearing request
deadline comes due. Do not wait until your first court date on a DWI/DUI
to retain an attorney!
- What
is an ALR hearing?
- Time is critical on this!!! You must file the
Petition given to you at the time of arrest within 10 days
of the arrest or you will automatically lose.
- The officer must
have a valid reason to pull you over.
- You do not have the right to refuse the breathalizer
test.
- Nebraska drivers have given their implied consent to be chemically
tested for drugs and alcohol by driving on the highways. If you
are pulled over, the arresting officer may request a sample of your
blood, breath, or urine for purposes of chemical analysis.
- You have the right to a jury trial.
- If you are convicted
of DWI/DUI, in some circumstances, you may qualify for
an ignition
interlock device.
